What we can’t help with

The Ombudsman does not have competence in the following matters:

  • when more than 6 months have elapsed since the citizen has been informed of the unlawful act or omission of the public administration, without responding to it
  • representing citizens in courts
  • investigating actions of the private sector or persons (except in the case of children’s rights violation or equal treatment violation)
  • the status of civil servants, unless there is unlawful discrimination against a civil servant on the grounds of sex, ethnic origin, religion or belief, sexual orientation, age and disability
  • national defence and security, foreign policy and international relations of the country or state security
  • cases already pending in courts
  • acts of the judicial authorities, the Legal Council of State, or other Independent Authorities as to their main function and acts of religious legal entities of public law
  • acts of ministers and deputy ministers regarding their political function
  • in cases where the administrative action has created rights and favourable situations for third parties, which can be overturned only by a court judgment, unless these rights are evidently unlawful, or have environmental protection as their main objective.
