  • 28/08/2017 - Summary
    - Environmental management and protection of Chrysi Island in Ierapetra, Crete
    The Greek Ombudsman, in its recent findings report, sent to the competent Ministries established environmental degradation of the Chrysi Island in Lasithi (Gaidouronisi), as well as illegal constructions and activities, in breach of the specific institutional framework destined to protect the site. The Independent Authority notes that the ineffective implementation of the legislative framework, the inability to accelerate the administrative procedures, the involvement of multiple State agencies as well as the individual economic interests make it difficult to find a mutually acceptable and realisable solution.

    - Cleaning of a landfill in a pothole in Agia Anna, Voiotia
    The Hellenic Speleological Society complained to the Ombudsman on the operation of an Area of Uncontrolled Waste Disposal in Agia Anna, Voiotia. The competent agencies, in the presence of the Ombudsman’s representatives, carried out an inspection which confirmed severe environmental degradation, due to the fact that the area had been used over a prolonged period of time for the community’s waste disposal. Following the Ombudsman’s intervention, administrative procedures started for cleaning and protection of the area; a more recent inspection verified successful cleaning of the pothole by the effective removal of waste from within it.

    - Intervention of the Ombudsman concerning the implementation of provisions legalising illegal constructions
    The Ombudsman received a number of complaints concerning the legalisation of illegal constructions through the implementation of provisions in force prior to Law 4178/2013. The Independent Authority established failure of the competent agencies to implement the procedure for corrections or reimbursement of fines due to the delay in issuing the ministerial decree foreseen in the abovementioned Law and expressed its views in a document addressed to the Ministry of the Environment and Energy.

    - Views of the Ombudsman on the procedure for the licensing of mobile phone antennae
    Following a series of complaints related to the installation and operation of mobile phone antennae, the Ombudsman recorded the main issues that have been identified with regard to the urban planning aspects for the installation and operation of mobile phone base stations, the environmental licensing procedure as well as the procedure of electrification of the antennae systems and sent a report to the Ministry of Infrastructure, Transport and Networks.
  • 13/01/2017 - Summary
    - Proposal of the Ombudsman for the completion of the process for establishing public space networks
    Following a series of complaints related to the characterisation of roads and the ineffective outcome of such cases, the Ombudsman recorded the main issues identified with regard to: a) lawfulness of building permits related to the lack of public space networks within city boundaries not having City Plan and b) the subsequent illegal occupation of public space. The Ombudsman, with its intervention to the Ministry of Environment and the Decentralised Administrations, called for the immediate processing of actions in cooperation with the competent departments of the local authorities. The purpose was to examine the possibility of legislating on the obligation of municipalities to define the public space networks without delay, giving an effective solution to this legislative malfunction constituting maladministration. The Authority pointed out that this legislation will significantly release the burden of a number of difficult cases pending before courts or the administrative bodies. However, despite the Ombudsman’s intervention, the issue has not been resolved and a new complaint has been filed in 2016.
