- Views of the Ombudsman on the procedure for the licensing of mobile phone antennae
Following a series of complaints related to the installation and operation of mobile phone antennae, the Ombudsman recorded the main issues that have been identified with regard to the urban planning aspects for the installation and operation of mobile phone base stations, the environmental licensing procedure as well as the procedure of electrification of the antennae systems and sent a report to the Ministry of Infrastructure, Transport and Networks.From: The Greek Ombudsman -

- Proposal of the Ombudsman for the completion of the process for establishing public space networks
Following a series of complaints related to the characterisation of roads and the ineffective outcome of such cases, the Ombudsman recorded the main issues identified with regard to: a) lawfulness of building permits related to the lack of public space networks within city boundaries not having City Plan and b) the subsequent illegal occupation of public space. The Ombudsman, with its intervention to the Ministry of Environment and the Decentralised Administrations, called for the immediate processing of actions in cooperation with the competent departments of the local authorities. The purpose was to examine the possibility of legislating on the obligation of municipalities to define the public space networks without delay, giving an effective solution to this legislative malfunction constituting maladministration. The Authority pointed out that this legislation will significantly release the burden of a number of difficult cases pending before courts or the administrative bodies. - Ombudsman’s proposal for amendment of the PPC arrears settlement programme (Public Power Corporation)
Citizens appealed to the Ombudsman requesting inclusion in the PPC arrears settlement programme, which had been under way since April of 2016. In particular, they protested against the rejection of their application for inclusion in the 36-instalment settlement, because of previous power supply discontinuation. The Ombudsman addressed the PPC asking that customers, who already had a settlement of their overdue obligations under the previous conditions, be able to benefit from the recent more favourable terms, while stressing that it is important to give equal opportunities to customers who fulfil the same criteria. The PPC failed to respond to the Ombudsman’s document, although the settlement programme was extended till the end of the year. - Special report on return of third country nationals
The Greek Ombudsman, Andreas Pottakis, publicized on September 29, 2017, his special report titled “Return of third country nationals - 2016”. In his third annual report on the issue the Ombudsman notes that the number of forced returns operations has decreased, in 2016, whereas the number of detainees has increased. The Ombudsman also notes the lack of adequate and timely information provided to third country nationals regarding the removal operation as well as the wrongful use of handcuffs as a standard procedure without individual assessment of its necessity. At a European level, the Ombudsman observes the problems in managing mixed flows of both migrants and asylum seekers along the south east borders of the EU and calls for the strengthening of an external control mechanism to monitor the return operations.From: The Greek Ombudsman

- Prevention of torture and ill-treatment – Special report 2014
This is the first annual Special Report of the Greek Ombudsman, acting as the National Preventive Mechanism of Torture, according to its special competence provided in Law 4228/2014 (article 2) which ratified the Optional Protocol to the UN Convention against Torture and other cruel inhuman or degrading treatment or punishment. The mission of the National Preventive Mechanism includes: visits, with or without prior notice, to places of deprivation of liberty; the investigation of the treatment of persons detained in these facilities on regular basis; the submission of respective improvement recommendations to the competent authorities, and finally the submission of proposals and comments regarding the existing legislation or draft laws. The assignment of this special competence to the Greek Ombudsman is a positive step towards the enhancement of human rights protection in our country, but also the recognition of the validity and reliability of the independent authority.From: The Greek Ombudsman -
