The invitation of the Ministry of Foreign Affairs for recruiting experts is contrary to the principle of equal treatment

Description

The Ombudsman examined an invitation from the Ministry of Foreign Affairs concerning the recruitment of five experts, which excludes the participation of candidates:
 
  • Who are Greek citizens by naturalisation but have not completed 3 years since the acquisition of the Greek nationality
  • Who have not reached the age of 32
  • Who suffer from serious cardiovascular or respiratory or renal or contagious diseases or serious diseases of the nervous system.
 
According to the recent equal treatment legislation (Law 4443/2016), the principle of equal treatment irrespective of race, colour, national or ethnic origin, birth, religious or other beliefs, disability or chronic illness, age, family or social status, sexual orientation, gender identity or gender characteristics in the labour market, applies to all individuals, in the public and private sectors in terms, inter alia, of the conditions of access to employment in general, selection criteria and recruitment terms, irrespective of the branch of activity and at all levels of the professional hierarchy, as well as the conditions of service and professional development.
 
The Ministry replied that in the context of amending its by-laws, which is in progress, will take into account the disputed provisions.
