Travel documents to beneficiaries of international protection holding a long-term residence permit
Description
A refugee and holder of a “long-term residence-work permit” of the Hellenic Republic, filed a complaint with the Ombudsman regarding an application submitted to the Aliens Directorate of Attica of the Hellenic Police, for renewal of his travel document (TDV - Titre de voyage).
In particular, the alien requested the renewal of his travel document as a "long-term resident", status which he had been granted in 2015, after having handed over his previous residence permit and the " Special ID card for political refugees", which he held because of his refugee status.
The Attica Aliens Directorate was hesitant to accept the request, arguing that, after having been granted the long-term resident status, the applicant had lost his refugee status and was therefore not entitled to the particular travel document. At the same time, the Aliens Directorate addressed a relevant question to the Ministry of the Interior, and, as there was no answer, the Police Authorities refrained from examining similar requests.
The Ombudsman pointed out to the Ministry of the Interior, Aliens Directorate that, under the law, the long term residence permit may also be granted to beneficiaries of international protection; it is sufficient to add the remark: “Granted international protection from the Hellenic Republic” on the Permit.
Consequently, the alien fully maintains his right to international protection; handing over his "Special ID card for political refugees", is perceived simply as replacing it by a new residence permit offering him access to improved living conditions in the host country. In this direction, all legal consequences which apply to beneficiaries of international protection remain valid, including the issue of travel documents.
The Ministry of Interior responded positively to the Ombudsman's proposals and informed the Police Aliens Directorate of Attica, which proceeded immediately with the issue of the travel document to the alien.
